Financial stress costs organizations nearly $2,000 per year per employee with the average employee wasting nearly 20 hours per month dealing with money problems. These actions may trigger notice obligations under the WARN Act. To avoid WARN, and the legal claims that often go hand-in-hand with job cuts, many employers are exploring creative alternatives. This presentation will take an in-depth look at the WARN Act, and help you know when you need to comply with its notice obligations. It will also explore cost-saving alternatives that can reduce the potential for expensive litigation.

BENJAMIN J. NAYLOR is an attorney with Quarles & Brady, LLP in Phoenix, Arizona. Mr. Naylor's practice focuses on counseling and representing employers in matters related to human resources, preventing and defending lawsuits and administrative actions, and advising employers on current trends and compliance with state and federal employment laws. Mr. Naylor also practices employment and commercial litigation, and has defended employers of all sizes ranging from small start-ups to Fortune 500 companies in state and federal lawsuits. In addition to preparing comprehensive employment policies and handbooks for employers nationwide, Mr. Naylor advises employers on how to best protect their confidential information and other resources through the effective use and enforcement of restrictive covenants. Mr. Naylor received his Juris Doctorate degree, with distinction, from the University of Iowa College of Law where he was a member of the Journal of Corporation Law. He received his bachelors degree, with distinction, from the University of Iowa.

Painless Performance Conversations: Helping Leaders through the Hard Talks
Have you ever received one of those phone calls from a supervisor? “I need help! One of my employees is a poor performer and I want to fire them.” The supervisor has prepared little documentation about the employee’s performance and has not adequately discussed the concern with the employee. In addition, the employee often has a documented history of positive or adequate performance. It’s an all-too-common dilemma. Performance conversations can be emotion-laded, filled with judgment, and are often avoided. Unfortunately, the consequences of avoidance can be severe for both the employer and the employee. Performance conversations can be a productive and positive experience for both leaders and employees. This interactive session will offer new tools and concepts that can be used when coaching and/or training supervisors and managers to conduct performance conversations.
