Session Description
What is Critical Thinking?
Critical thinking is a set of concepts and principles that help people analyze and assess that which occurs in life. It is grounded in personal and intellectual integrity, humility, mutual respect, empathy, fair-mindedness, and self-discipline. Critical Thinking is crucial because it: helps remove siloed thinking (“us versus them” mentality); helps minimize irrational thinking, prejudices, distortions, social rules and conventions that have been unquestioned for the sake of vested interests; and is a way to help society as a tool to examine injustices. All action is based on thought; when thoughts are flawed so too are actions and outcomes.

Speaker Bio
Ms. Culbertson represents and counsels management clients in connection with all types of labor and employment matters arising under federal and state law. Ms. Culbertson’s practice focuses on litigation against the Equal Employment Opportunity Commission. Prior to joining Littler, Ms. Culbertson served as a Judicial Clerk to the Honorable Paul G. Rosenblatt, United States District Court, and District of Arizona. During the two and half years with Judge Rosenblatt, she was involved with a myriad of labor and employment matters from the filing of the Complaint through the determination of post-trial motions. Ms. Culbertson is a member of the State Bar of Arizona. Ms. Culbertson received her B.A., summa cum laude, from Arizona State University in 1998 and her J.D. degree from Arizona State University College of Law in 2000.

In time of national economic hardship, employers face many difficult decisions regarding their workforce. Reductions involving foreign workers, however, may have lasting effects both on the employer and the employee. In this session we will discuss:
• What impact will a reduction in force have on your foreign workers?
• What issues arise for a company that continues to sponsor foreign workers while also eliminating positions held by U.S. citizens?
• Is your company prepared for the issues involved in hiring new or rehired foreign workers during an economic downturn?

David S. Jones is a Partner in the Las Vegas office of Jackson Lewis LLP. David regularly advises clients on complex employment immigration matters such as Extraordinary Ability petitions for artists and entertainers, Outstanding Professor/Researcher and National Interest Waiver petitions for academics and researchers, and numerous other types of immigration petitions and applications. David has extensive experience in assisting companies with hires or transfers of employees from outside of the U.S.
Jeffrey W. Toppel is an associate in Jackson Lewis LLP’s Phoenix office. Mr. Toppel represents employers in a wide range of employment-related disputes, including wrongful termination and discrimination claims before various state and federal governmental agencies, as well as in Arizona state and federal courts. Mr. Toppel also represents parties in restrictive covenant and trade secret litigation. In addition to his litigation practice, Mr. Toppel regularly advises employers on issues that arise in the workplace, including compliance with state and federal immigration laws affecting the workplace.

One of the big draws to this particular topic is that I make a Personal Communications Assessment available to the participants both before and after the session. I provide this at no cost to the participants and will not ask for AZ SHRM to cover the costs. This is an added value to the SHRM attendees.

Patrick is the President of Leadership Choice, a professional training & development organization, focused on improving the impact and interpersonal effectiveness of your most critical leaders. Prior to founding Leadership Choice, he was Vice President with Right Management a global professional services organization, as well as Senior Organizational Consultant and Director of Training and Development in the manufacturing and Professional Services Industry. Patrick holds his B.A. from Arizona State University and an M.S. in Industrial / Organizational Psychology from Lamar University.
